Medical malpractice happens when a healthcare provider deviates from the “standard of care.” The “standard of care” is a term to describe the generally accepted medical practices that a healthcare provider would do (or would not) under the same circumstances.

Fall From Bed Injuries

It is the hospital’s responsibility to protect you while in their care. If a nurse forgets to put up a bed rail or a patient isn’t checked on regularly, it can result in a patient falling out of bed. Often times, elderly patients are frequent victims of this because they were not properly evaluated as a fall risk or the procedures for fall risk patients were not properly taken.

Birth Injuries

In some cases, the choices made by a doctor during childbirth may have been medically ill-suited or proper skill and care was not used during childbirth, which can cause injuries. Delivery injuries can include Erb’s Palsy, Hypoxic-Ischemic Encephalopathy (HIE), birth fractures, and injuries resulting from vacuum extraction.

Misdiagnosis or Delayed Diagnosis

A patient’s condition can be made much worse if a doctor fails to diagnose or makes an incorrect diagnosis. This can lead to incorrect treatment, delayed treatment, or no treatment at all.

Hospital Negligence

Hospitals are responsible for the facilities, physicians, nurses, specialists and medical assistants hired to provide patient care.  Hospital negligence can include unclean or improper medical equipment or misconduct by a physician or nurse.

Surgical Errors

Surgical errors are preventable mistakes during surgery.  All surgeries carry a risk, but if a surgeon deviated from the “standard of care” it could be considered medical malpractice. Surgical errors can result from poor planning, improper work process, poor communication and fatigue.
